Terms of Service

1. About these terms

These Terms of Service govern your use of Retinote, a CPD tracking platform operated from Brisbane, Queensland, Australia (ABN available on request). By creating an account or using Retinote, you agree to these terms. If you do not agree, do not use the service.

We may update these terms from time to time. If we make material changes we will notify you by email or in-app notice. If you keep using Retinote after the changes take effect, the new terms apply.

2. Your account

You must be at least 18 years old and a registered optometrist (or optometry student) to use Retinote. You are responsible for maintaining the security of your account credentials. Notify us immediately at support@retinote.com.au if you suspect unauthorised access.

You may not share your account with others or create multiple accounts for the same individual. We reserve the right to suspend or terminate accounts that violate these terms.

3. Subscription and billing

Retinote is offered on an annual subscription basis. Prices are displayed in Australian dollars. Payments are processed securely by Stripe.

Your subscription renews automatically each year unless you cancel before the renewal date. To cancel, turn off auto-renewal in Profile. You keep access until the end of the period you've paid for. We do not provide refunds for partial subscription periods unless required by Australian Consumer Law.

If you delete your account, your subscription ends straight away and the unused part is not refunded, except where the Australian Consumer Law requires it.

Access through an organisation.If an organisation (such as your union) provides your access, its arrangement with us decides how long you have access, and the billing terms above don't apply to you. If the organisation stops providing access, you can subscribe yourself to keep using Retinote.

4. Acceptable use

Don't use Retinote unlawfully, try to break into or disrupt it, copy or resell it, or scrape it with automated tools.

5. Your content

Your records belong to you. You let us store and process them only to run Retinote for you. Don't upload anything you don't have the right to share.

6. AI-generated content

Retinote can use AI to draft reflections and suggest learning goals. AI text is a starting point and may be wrong. Check and edit it before you save or submit it to AHPRA or anyone else. AI features only work if you expressly consent to Retinote using AI on your data. Our AI assistance terms also apply.

7. Intellectual property

All intellectual property in the Retinote platform, including software, design, trademarks, and documentation, belongs to Retinote. Nothing in these terms transfers any intellectual property rights to you.

Retinote Learning. If you use Retinote Learning, our Retinote Learning terms also apply.

8. Limitation of liability

We aim to keep Retinote running but can't promise it will always be available.

To the maximum extent permitted by law, Retinote and its operators are not liable for any indirect, incidental, special, or consequential loss arising from your use of the service, including loss of data, loss of revenue, or regulatory penalties.

Our total liability to you for any claim arising out of or in connection with these terms is limited to the amount you paid for your current subscription period.

Nothing in these terms excludes or limits any rights you have under the Australian Consumer Law that cannot be excluded or limited.

9. Termination

You can view and export your records while your subscription is active. If it ends, we keep your records, but you can't view or export them until you subscribe again. You can delete your account at any time in Profile (or from the subscription-expired page if your subscription has ended).

We may suspend or terminate your account immediately if you breach these terms or if we are required to do so by law. If we terminate your account, your right to access Retinote ends, and we handle your data as our Privacy Policy describes.

10. Governing law

These terms are governed by the laws of Queensland, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of Queensland.
