Terms of Service

1. About these terms

These Terms of Service govern your use of Retinote, a CPD tracking platform operated from Brisbane, Queensland, Australia (ABN available on request). By creating an account or using Retinote, you agree to these terms. If you do not agree, do not use the service.

We may update these terms from time to time. If we make material changes we will notify you by email or in-app notice. Continued use of Retinote after the effective date of updated terms constitutes acceptance.

2. Your account

You must be at least 18 years old and a registered optometrist (or optometry student) to use Retinote. You are responsible for maintaining the security of your account credentials. Notify us immediately at support@retinote.com.au if you suspect unauthorised access.

You may not share your account with others or create multiple accounts for the same individual. We reserve the right to suspend or terminate accounts that violate these terms.

3. Subscription and billing

Retinote is offered on an annual subscription basis. Prices are displayed in Australian dollars and are inclusive of GST where applicable. Payments are processed securely by Stripe.

Your subscription renews automatically each year unless you cancel before the renewal date. You can cancel at any time from your account settings. Cancellation takes effect at the end of the current billing period. We do not provide refunds for partial subscription periods unless required by Australian Consumer Law.

4. Acceptable use

You agree not to:

  • Use Retinote for any unlawful purpose or in violation of any applicable regulation.
  • Attempt to gain unauthorised access to any part of the service or its underlying systems.
  • Upload or transmit malicious code, viruses, or any content that could harm the service or other users.
  • Reverse engineer, decompile, or attempt to extract the source code of Retinote.
  • Resell or sublicense access to Retinote without our express written consent.
  • Use automated tools to scrape, crawl, or extract data from the platform.

5. Your content

You retain ownership of all CPD data, notes, and other content you create in Retinote. By using the service, you grant us a limited licence to store, process, and display your content solely for the purpose of providing the service to you.

You are responsible for ensuring that any content you upload does not infringe third-party intellectual property rights or violate any law.

6. AI-generated content

Retinote includes features that use AI to generate reflections and summaries based on your CPD data. AI-generated content is provided as a starting point and may not be accurate. You are solely responsible for reviewing, editing, and verifying any AI-generated content before submitting it to AHPRA or any other body.

7. Intellectual property

All intellectual property in the Retinote platform, including software, design, trademarks, and documentation, belongs to Retinote. Nothing in these terms transfers any intellectual property rights to you.

8. Service availability

We aim to provide a reliable service but do not guarantee uninterrupted availability. We may perform maintenance, apply updates, or experience downtime outside our control. We will endeavour to provide advance notice of planned maintenance.

9. Limitation of liability

To the maximum extent permitted by law, Retinote and its operators are not liable for any indirect, incidental, special, or consequential loss arising from your use of the service, including loss of data, loss of revenue, or regulatory penalties.

Our total liability to you for any claim arising out of or in connection with these terms is limited to the amount you paid for your current subscription period.

Nothing in these terms excludes or limits any rights you have under the Australian Consumer Law that cannot be excluded or limited.

10. Termination

You may close your account at any time from your account settings. We may suspend or terminate your account immediately if you breach these terms or if we are required to do so by law.

Upon termination, your right to access Retinote ceases. You may export your data before closing your account. We will delete your data in accordance with our Privacy Policy.

11. Governing law

These terms are governed by the laws of Queensland, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of Queensland.
